Posting employees is a process in which employees are temporarily sent by his or her employer to perform work for another company based in another country. The tripartite connection set between the posting company , the host company and the posted employee is subject to specific legislation and procedures, one of the main objectives of which is to respect the employees’ rights.
Ruled by the principle of freedom to provide services (Article 56 of the Treaty on the Functioning of the European Union (TFEU), posting employee authorizes companies based in a European Union Country to provide services in another States member while residing in their country of origin.
It is the duty of the sending company to appoint a legal representative who is responsible for fulfilling, on its behalf, the obligations required in that host country of the posted employees
